The Gujarat High Court Tuesday extended until November 21 is the formulation of charges against the suspended IPS Director Sanjiv Bhatt in 1990 cases of torture in custody Jamnagar court sessions.
Justice RH Shukla extended stay after the lawyer Bhatt told the court that SC is 10 October for refusing to plea Bhatt was brought before the Supreme Court. The lawyer asked the court to extend the stay until SC performs advocacy for the deaf.
On October 10th denial of justice Shukla Bhatt plea challenging the order of the court of sessions at Jam Khambhalia to allow the state government to withdraw an application to the charges against the Bhatt and other officers should be removed. The Government’s application was pending before the courts since 1996. But Bhatt implicated Chief Minister Narendra Modi in 2002 riots, the government decided to remove the protection for Bhatt in this criminal case.
When Bhatt was posted as Additional Superintendent of Police in Jamnagar, 150 people were arrested for the control of communal riots in the city of Jodhpur Jam. One detainee, Prabhudas Vaishnani had to be hospitalized after being released. Would not have died of kidney failure. His brother filed an FIR against Bhatt and six police officers for committing the murder by torture in detention. CID (crime) was the probe and the government has sought sanction to prosecute the policemen. However, the state has refused to sanction.
A magisterial court refused to accept the closure report of the case, and the government filed the application for review in the court of sessions requesting that charges be dropped. But after the government withdrew its request, the trial court at Jam Khambhalia initiated criminal proceedings against Bhatt.
