EC transfer order: IPS may contest

The IPS Officers’ Association is reportedly thinking of legally challenging the Election Commission’s order to shift top police officials ahead of the Gujarat Assembly elections. Sources told The Times Of India that this time the political establishment was miffed at the “audacious manner” in which the Election Commission directed removal of DGP P C Pande, Ahmedabad police commissioner J Mahapatra and four other police officers on Monday.

The Bharatiya Janata Party had openly objected to the proposed transfers at a press conference on Tuesday.

“The EC has to give proper grounds for the transfer,” said a senior police officer. However, according to sources, since the police officers cannot move court on their own, this should be done by the association or the state government.

The police association is seeking legal opinion on the implications. A top lawyer said the litigation would be filed on behalf of the state government. Senior counsel were going through Supreme Court judgments to prepare briefs.
The Election Commission had been giving indications of revoking certain transfer orders, especially the ones
issued on September 30, days before the EC was to visit Gujarat.

This transfer order by the state government saw several police officers close to the ruling regime shifted to key districts.
